Why This Notice Is Necessary

FCL/StarDent is required by law to maintain the privacy of Protected Health Information ("PHI") and to provide individuals with notice of FCL/StarDent's legal duties and privacy practices with respect to PHI. PHI includes information that can be used to identify you and has been created or received about your past, present or future health or condition, the provision of health care to you, or the payment for this health care.

This notice explains our privacy practices that are applicable to you, a valued member of FCL/StarDent. We appreciate the confidence and trust that you have bestowed upon us. Your privacy is very important to us, and we take this duty seriously.

FCL/StarDent is required to follow the privacy practices that are described in this notice. However, we reserve the right to change the terms of this notice and our privacy practices at any time. Any changes to our policies and procedures will apply to the PHI we already have in our possession. If we make a material change to our policies and procedures about your PHI, we will update this notice, post a new notice on our web site at Privacy Policy and, to the extent required by applicable law, promptly mail a notice of the changes to you.

FCL/StarDent's Need for Information to Provide Services

The types of PHI we collect on each of our members will include, but not necessarily be limited to: (i) information that you provide to us or that we receive from regulatory authorities, your employer or benefits plan sponsor (such as your name, address, social security number, date of birth, dependent information, marital status, health or medical history, employment information and other insurance carrier history); and (ii) information on your interaction with any of our agents, business partners, or other parties (such as medical records, health care claims, premium payments, verification of your eligibility, appeal and grievance information, information to process requests for health care authorizations and enrollment applications). STARDENT/FCL acknowledges participants' privacy rights as specified in the Privacy Rule of the Administrative Simplification provisions of the Health Insurance Portability and Accountability Act of 1996, and has implemented policies and procedures to ensure these privacy rights are protected.

PROCEDURE

Participants in STARDENT/GUARANTY/FCL have the right to:

  • Receive a paper copy of the STARDENT/GUARANTY/FCL Health Plan's Notice of Privacy Practices ("Notice"), even if participant has agreed previously to receive the Notice electronically;
  • Request restrictions on the uses and disclosures of Protected Health Information ("PHI"); . Request receipt of confidential communication by an alternative means or at an alternative location if appropriate cause is shown; . Access documents in the designated record set for inspection and/or copying;
  • Request to amend documents in the designated record set that are inaccurate or incomplete; and . Obtain an accounting of disclosures of their PHI.
  • STARDENT/GUARANTY/FCL adheres to policies and procedures that were developed and implemented to ensure participant privacy rights.
  • STARDENT/GUARANTY/FCL provides workforce members who perform plan administration functions with training regarding participant rights with respect to their PHI.

PARTICIPANT REQUESTS FOR CONFIDENTIAL COMMUNICATIONS

Participants in the Health Plan of the STARDENT/FCL DENTAL PLANS Health & Employee Benefits Pool (STARDENT/GUARANTY/FCL) have the right to request restrictions on how and where their Protected Health Information ("PHI") is communicated. STARDENT/GUARANTY/FCL will not discriminate or retaliate against any participant for making such a request.

  • Participants who desire their PHI to be communicated in a manner or location other than the Health Plan would otherwise use, may request a specific alternative location or other method of communication.
  • To be entitled to any requested restrictions, a Participant must clearly establish that the restriction is necessary to prevent an unlawful disclosure.
  • Even if the participant fails to establish that a failure to grant the request would result in an unlawful disclosure, STARDENT/GUARANTY/FCL will accommodate reasonable requests unless the requests impose an unreasonable administrative burden.
  • The participant may request confidential communication at any time.

  • Written documentation of the participant's request, if granted, will be placed in the participant's record(s).
